Consumer Health Data Privacy Policy

Last updated: October 2026

This policy covers "consumer health data" as defined by Washington's My Health My Data Act, Nevada's SB 370 and similar state laws. In Tend, that's almost everything you enter about the person you care for, and your own wellbeing check-ins. It adds to our Privacy Policy. Where the two differ, the one that protects you more applies.

What we collect

We don't collect or store consumer health data on our servers. Everything you enter stays on your phone. There's no account.

The one exception is the AI features, which are optional. When they're on, the text a feature needs is sent to Anthropic to produce an answer, after names and identifiers are removed. That text can include:

Our relay passes it through without keeping it. Wound photos and caregiver check-ins are never sent.

Why it's sent

Only to provide the AI feature you asked for: reading a document into your care plan, the morning briefing, caregiver tips, or a symptom check. It's never used for advertising, for profiling, or to train AI models.

Who receives it

We have no affiliates that receive consumer health data. We do not sell consumer health data.

Consent

You choose whether to use AI features when you set Tend up, and you can turn them off at any time in Settings. With AI off, nothing is sent. Usage statistics are off unless you turn them on, and never include health information. Before Tend offers accounts or sharing, we'll update this policy and ask for your consent in the app.

Your rights

You can confirm whether we collect, share or sell your consumer health data, get a list of who receives it, ask for it to be deleted, and withdraw consent. Because your care plan stays on your phone, deleting records in the app or deleting the app removes it. Turning AI off stops anything being sent.

For anything else, email hello@commongenelabs.com with "Health data request" in the subject. We'll answer within 45 days. That can be extended once by 45 days when reasonably necessary, and we'll tell you why. If we decline, you can appeal by replying to our decision, and we'll answer within 45 days. If you're still not satisfied, you can contact your state attorney general, for example the Washington State Attorney General.

We don't discriminate against you for using these rights.

Geofencing

We don't use geofencing or location data.
